Insurance Claims, two checks....?

Willis Liburd: That one is not your money, but not sure who it should go to. Call your own claims department and ask them if you need to endorse it and send to them, or if they recommend you return it to the other company and they will just subrogate later. But don't keep it by any means; though you don't intend it, that is insurance fraud and a serious crime....Show more

Bernadette Roel: They eventually catch up to each other and you will get a small problem. Like, you have to pay for one of the checks in full. Why don't you return the check (Or contact your insurance company on what to do), or destroy one of them.It is possible you could go to jail for fraud.

Mayola Sylva: Nope, your insurance is going to go after the other insurance for reimbursement. You should send it in to YOUR insurance, minus the deductible, which you can keep.

Lady Laflin: It will probably catch-up with you when your insurer sends a demand for re-payment to the other insurer an! d the other insurer provides them proof they already paid you. The only way it goes unnoticed is if your insurer thinks it's your fault AND the other insurer thinks it's their guys fault AND the email notice that's sent to both adjusters notifying them of the double payment is ignored by both of them. Possible but not likely.Best thing is to tear-up the check from the other guys insurer or send it back. If you destroy it then make sure you call the adjuster at the other company and tell them. If they have to stop-pay the check after they receive the demand from your carrier it will only delay you getting your deductible back....Show more
