Car insurance, accident & medical bills?

Bennie Lantgen: Not sure if this matters - my insurance company is paying out & then going after his insurance. My claim is still not settled because I just got my car back Friday & there are still issues with the rental car. Does all of this need to be settled before I hear from his insurance?

I was told that wasn't covered under my insurance & his insurance would need to contact me. The ambulance company asked for my car insurance info & I have not received a bill, so I'm assuming! my insurance company took care of it. However, I now have copays for physical therapy for my neck & back. How does this work? Do I need to contact his insurance or will his insurance be contacting me? Kristina Brockwell: Okay, first of all, I'm very sorry to hear that you got in a car accident. That always sucks!Now onward with your answers! Unless you have med pay coverage on your insurance (usually recommended for people who don't have health insurance, judging by your co-pay comment, I bet you have health insurance), than they are correct, your insurance will not cover that. If you have med pay, it will be a number on your policy that's either $1000, $3000, $5000, or $8000. Somewhere in there. If the other driver was at fault in the incident, than yes, the other company is responsible for your bill as well as your co pays. Keep records of EVERYTHING and don't pay ANYTHING IN CASH!!! !!!!! Check or credit card so there is a solid record of it. N! ow, if you gave your insurance company's information, sometimes companies will do something called a subrogation of liability. Normally it's with much high dollar items that include full lawsuits, but the simple meaning is that if the other company doesn't pay for something they should at first, your company will foot the bill, and send all their sharks and lawyers after the other company to sue them and make them pay what they are responsible for. They usually only do this when it's an OBVIOUS case. Normally, his insurance would have contacted you by now, but they sound lazy. Be EXTREMELY CAUTIOUS when talking to them on the phone. Everything is recorded, and it's there job to try and get you to admit that you are partially at fault for something. These people make great salaries to save the company money, and they are damn good at it. Sometimes they might harass you. If that's the case, contact the insurance commissioner for your state, and they will threaten to disbar th! em from practicing in your state, and they'll back off. Lastly, make sure that you are made whole from this situation. It is the responsibility of insurance companies to bring you back to the previous position you were in BEFORE the incident. Maybe I love it so much because I am a licensed insurance agent, and got disheartened by how dishonest some people can be in that industry. Jacinta Moitoso: Bad assumption. Any medical bills paid by car insurance, won't have any copays or deductibles. Ambulances - or anything else - won't bill your insurance directly. You'll want to save ALL your receipts, and submit them to his insurance. If you can. NOTHING will settle on medical bills, until AFTER you're completely done with all your medical treatments, including physical therapy....Show more

Leif Andreason: Per another question you posted, you stated you were rear ended, so there will be no dispute of fault. You need to call and talk to your adjuster to verify if you have either medical payment coverage and/or PIP on your policy. Either one should pay for all of your medical bills and treatment, including the ambulance, (IF), you have the coverage, up to the limits you purchased. With PIP, in some states there is a deductible and co-insurance, a good example is Florida which normally has a $2,500 dedu! ctible and 80% co-insurance. But, IF, you did not purchase medical pay! ment coverage and/or PIP, then (IF), you have health insurance, it becomes secondary to pay for any medical bills and treatment for this accident. If you have none, then you will be responsible for paying for all of your medical bills out of pocket.I do find it odd that this accident happened 6 weeks ago, but the other at fault insurance company has not talked to you? Most companies should contact you w/in a week, unless they have no clue who you are, like, they need the police report to find you. Since your insurance company will be going after the other company for your car and rental, ask the adjuster who to contact. Depending on what state you live in, once you are done treating, then the at fault insurance company will owe you for your injuries, in a settlement which will include REIMBURSEMENT of your medical bills (plus ambulance) and "some" pain/suffering. The job of an auto adjuster is to talk to ALL parties involved in an accident and to determind besides the c! ar damages, (IF), anyone is injured.
